1. Introduction
Welcome to WorldCultureStories ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at worldculturestories.sbs (the "Service") operated by WorldCultureStories.
When you book a charter or use our Service, you consent to our Terms. If you do not agree with any part of the terms, you are not permitted to use the Service.
2. Service Overview
WorldCultureStories offers premier yacht charter services, which include but are not restricted to:
- Daily yacht charters
- Evening cruises
- Business retreats
- Exclusive gatherings
- Extended charters
Our services are contingent on availability and climatic conditions. We can modify or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, you are required to:
- Have a minimum age of 18 years
- Supply accurate and complete details
- Remit the needed deposit as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking occurs only with the payment receipt and our written confirmation. We hold the discretion to deny service to anyone.
3.3 Availability
Charter availability is based on the accessibility of vessels and appropriate weather conditions. We will endeavor to meet your desired dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All pricing is presented in € and incorporates all applicable taxes unless stated otherwise. We reserve the right to alter prices without notice.
4.2 Payment Schedule
- Deposit: 50% of the overall charter cost is due at the time of reservation
- Final payment: Required 48 hours prior to the commencement of the charter
- Additional fees (if any): Due after the charter concludes
4.3 Payment Methods
We accept a range of payment methods including major credit cards, bank wire transfers, and certified checks. We process payments through secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours prior to departure: Full refund minus transaction fees
- If canceled between 24 to 72 hours prior to departure: Refund of 50%
- If canceled less than 24 hours prior to departure: Non-refundable
5.2 Weather Cancellations
Should the weather conditions be considered unsafe by our captain, we propose to either:
- Reschedule the charter to an alternative date at no extra charge
- Issue a full refund if a new schedule is infeasible
5.3 Mechanical Failures
If mechanical issues occur with the designated vessel, we will aim to provide an adequate replacement. Should a substitute not be available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions from the crew
- Don safety gear when required
- Disclose any medical issues that may impact their safety
- Stay within designated areas on the vessel
6.2 Prohibited Objects
The following are not allowed on board:
- Glass items
- Prohibited substances
- Weapons or firearms
- Excessive amounts of beverages (more than reasonable for personal consumption)
- Animals (unless prior authorization is obtained)
6.3 Behavior
Passengers should behave respectfully at all times. If a guest's conduct endangers safety or detracts from the enjoyment of others, we may terminate the charter without refunding.
7. Liability and Insurance
7.1 Limitation of Our Liability
We limit our liability to the cost paid for your charter. We are not accountable for:
- Personal harm arising from the negligence of guests
- The loss or damage of personal belongings
- Indirect or punitive damages, or any consequential loss
- Delays due to weather or situations outside our control
7.2 Coverage by Insurance
We maintain complete marine insurance that covers our vessels and operations. It is each passenger's responsibility to arrange their travel and personal insurance.
7.3 Acceptance of Risk
Engaging in our charter services signifies your recognition of the inherent risks in nautical activities, and you take responsibility for your personal safety and health.
8. Modifications and Itinerary Adjustments
Itineraries, paths, or schedules can be changed due to weather, safety concerns, or operational needs. We'll make substantial efforts to offer comparable alternatives.
9. Force Majeure
We do not hold responsibility for setbacks, cancellations, or modifications brought on by events beyond our command, this includes but is not restricted to:
- Extensive adverse weather
- Natural disasters
- Orders from authorities
- Port closures
- Vessel failures
10. Privacy and Personal Data Protection
Your personal data is managed following our Privacy Policy. By utilizing our services, you agree to our data collection and usage as outlined in the Privacy Policy.
11. Copyright and Trademarks
The content on our site, such as text, visuals, logos, and images, is safeguarded by copyright and trademark legislations. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express permission.
12. Applicable Legislation
The governing laws of Monaco dictate these Terms. Any disputes will be resolved within the judiciary of Monaco, Monaco.
13. Alterations to These Terms
We hold the right to amend these Terms at our discretion. Updates will be published on our website, showing the newest revision date. Subsequent use of our services after changes indicates your acceptance of the new Terms.
